As part of their respective mandate, the competent authorities (ex: the Autorité des marchés financiers, the Régie de l’énergie, MELCC, etc.) will monitor the use of the Environmental Markets Trading Platform (the "Platform"). The Quebec Business Council on the Environment (“CPEQ”) is not responsible for enforcing, monitoring or advising users regarding any applicable law or regulation relating to the Platform, but pledges to collaborate with any competent authority in enforcing any law or regulation. Users of the Platform are responsible for informing themselves and complying with any applicable law or regulation regarding the use of the Platform, for instance the regulation regarding hazardous materials and contaminated lands.
CPEQ’s Platform allows registered users to post, freely, "Invitations to negotiate" for potential purchases, sales, rentals, donations or sharing of certain environmental goods and to respond, if necessary, as the Platform is dedicated to facilitate the relationship and exchange of information between buyers, sellers, lessors, lessees, donors and donees, and to provide a valid price indicator to the Platform users.
The Platform registered users are fully responsible for their "Invitations to negotiate" published on the platform with a full discharge to CPEQ, its employees, agents, management, officers and directors.
The publication of an "Invitation to negotiate" is not binding in any way to the user who publishes on the platform. An "Invitation to negotiate" is neither a promise nor an offer to contract under the Civil Code of Québec.
CPEQ is not a party to a contract or is not bound by any contractual or non-contractual liability arising directly or indirectly from the use of the Platform.
CPEQ is not responsible for any damage arising from the use of the Platform including, but not limited to, the validity, the legitimacy or the value of environmental products subject to an Invitation to negotiate. It is the responsibility of all parties entering into transactions to buy, sell, rent, donate or any other, to make sure that they are acting in compliance with the obligations and exemptions under the applicable laws and regulations and to proceed with all necessary due diligence assessments to that effect.
The information transmitted to CPEQ through the use of the Platform will remain confidential, subject to a specific authorization for CPEQ to transmit information to a representative of the government of Quebec or of Canada, or for the means of an aggregation framework of information generated for the benefit of users, or following any order or judgment of a competent jurisdictional authority requiring the CPEQ to disclose confidential information.
Any copying, distribution, transmission, display, linking, deep-linking or any other way to change or modify this site or platform without the express written permission of CPEQ is strictly prohibited. Any violation of this provision may result in an infringement of intellectual property and can make you subject to civil and/or criminal penalties in addition to an exclusion from the Platform, at the sole discretion of the CPEQ.
